One thing I have been pretty good about is I do allow different points of view on this blog when I do get comments, which isn't very often. However, if you are going to argue in favor of the prosecution in the Arias case, you need to have some grasp of American criminal law.
Today I had an almost-hysterical couple of posts trying to argue what a "liar" Jodi Arias is about domestic violence. Well, the ONLY time she has lied at all was to the police and the media because she didn't have the knowledge she needed to have an attorney present before talking at all. She was not under oath when she said those things. ALL of the evidence supports her account, and, by the way, the prosecution changed the ORDER of the gunshot/stabbings AT THE LAST MINUTE. Detective Flores likely committed perjury in order to fit the prosecution's new scenario so that they could "prove" premeditation. The medical examiner's conclusions were so vague as to be meaningless.
The commenter cannot get it through her head that Jodi Arias could lie about EVERY SINGLE THING in this case and that STILL would not prove the state's case. The state CANNOT prove she committed first-degree murder. The state CANNOT prove it WASN'T self-defense. The state CANNOT prove it was second-degree murder. The state CANNOT prove it was manslaughter. The state CANNOT prove it was negligent homicide. The ONLY acceptable outcome is an acquittal because the burden of proof is on the prosecution. The defense did not have to even present a case or call witnesses at all. From the time the sex tape and emails were introduced, the prosecution's case went up in smoke.
Now something new could come up that would prove the prosecution's case, and I could change my view. However, I don't think that is likely.
HOWEVER, because the jury was NOT sequestered, there is no guarantee that jury hasn't been watching truly despicable "news" coverage where the aim is to destroy a defendant's right to a fair trial in a cynical attempt to bolster ratings and make money from advertisers. IF there is a first-degree murder conviction despite there being NO evidence of such, the conviction will most likely overturned on appeal thanks to the numerous instances of misconduct by the prosecution.
My belief is there will be a hung jury in this case resulting in a mistrial. I even believe prosecutor Juan Martinez is TRYING to get a mistrial granted because of his blatantly unprofessional antics.
Many other sites are being inundated with people purportedly supporting the victim in this case, Travis Alexander, but I don't believe he would approve of the extent of the hatred. Many people are hiding behind the anonymity of the internet and making what amounts to death threats. Alyce LaViolette has been the most recent target of insane threats on her career. As for this blog, any hateful stuff will be deleted from the "hopper" here without them ever seeing "publication" on this blog if posters cannot comment halfway decently.
